Telangana HC Invalidates Governor’s Rejection of MLC Nominations
In a significant ruling, the Telangana High Court has invalidated the order of the Governor rejecting the nominations of Dasoju Sravan Kumar and Kurra Satyanarayana as Members of the Legislative Council (MLCs) under the Governor’s quota. Additionally, the court quashed the notification nominating M. Kodandaram and Amer Ali Khan as MLCs, emphasizing that the Governor must act on the advice of the Council of Ministers while exercising powers under Article 171(5) of the Constitution of India.
While providing the Governor with the opportunity to reassess the eligibility of the petitioners based on the Council of Ministers’ recommendation, the court clarified that the Governor is not considered an officer of the court under Article 361 of the Constitution. The nominations of Sravan Kumar and Satyanarayana, recommended by the previous Bharat Rashtra Samithi (BRS) government, were rejected by the Governor, leading to a legal challenge and subsequent court ruling.
