Kerala High Court Dissolves 38-Year-Old Marriage Due to Irretrievable Breakdown

The Kerala High Court has intervened to dissolve a 38-year-old marriage that had irretrievably broken down, stating that keeping parties together in such circumstances would amount to cruelty to both parties. The decision came in response to an appeal filed by the husband after a family court dismissed his plea for divorce on grounds of cruelty.

The husband claimed neglect and a breakdown in the marriage, while the wife denied these allegations. The high court concluded that the marriage could not be revived and, in line with a Supreme Court judgment, ruled that retaining such a marriage would be cruel to both parties, ultimately granting the divorce.
