The Delhi High Court, in a significant decision, rejected a petition seeking the removal of Chief Minister Arvind Kejriwal from office following his arrest by the Enforcement Directorate in a money laundering case linked to the excise policy. Acting CJ Manmohan and Justice Manmeet P. S. Arora asserted that there was no room for judicial interference in this matter, emphasizing that it was within the purview of the executive branch to address such issues in accordance with the law.
The petitioner, Surjit Singh Yadav, had contended that Kejriwal’s tenure as Chief Minister could lead to disruptions in law and order and a breakdown of the state’s constitutional machinery. However, the court sought clarification on any legal impediments preventing Kejriwal from functioning as Chief Minister while in custody, highlighting that such issues fell under the jurisdiction of the Governor and the President.
